Perhaps the most effective way to protect against
termination liability is to draft a release agreement with the
dismissed employee. This agreement would greatly diminish the
possibility of an IT employee successfully filing a lawsuit for
wrongful discharge since the employee waives any employment claims.
In order for the release agreement to be binding,
the employee must be given consideration. This represents something
above and beyond what the employee is entitled to by law or existing
contract. This consideration may be in the form of various agreements
as referenced in the following paragraphs.
